1. Booking and Payment

1.1. The property is let to you for the period stated in your booking confirmation. You agree to not sublet or assign the property or any part of it. Extensions are subject to availability and approval by the Property Manager.
1.2. An automated 50% deposit will be charged to your credit card at the time of booking. A 2% service fee applies to all credit card payments. The balance will be due one week prior to arrival and can be paid via credit card, bank transfer or cash on arrival.
1.3. All amounts are expressed and processed in Australian dollars. ($AUD)

2. Residential Amenity & Good Neighbourly Behaviour

2.1. The Visitor must comply with the By-Laws that apply to the property, engage in good neighbourly behaviour, preserve the residential amenity and not be a nuisance or annoyance to adjoining or neighbouring occupiers (eg. loud music, parking). Particularly noise should be kept to a minimum between 10pm and 8am.
2.2. The maximum number of persons that may be accommodated at the property is specified in your booking confirmation. Excess persons will be required to vacate the property or a pro rata charge may apply if appropriate bedding is available at the property at the Property Manager’s discretion. All properties have a strict no party and no functions policy unless prior express written approval is granted by the Property Manager.
2.3. The Visitor must leave the property in a clean and tidy condition, and adhere to recycling/garbage removal programs.

3. Bond/Security Deposit and Property Damage

3.1. A Bond/Security Deposit may be required. Return of these amounts is based on Torquay Retreats terms and conditions and their inspection of the property after your stay.
3.2. The Visitor may not remove any of the furniture or effects from the property and will be liable for any furniture or effects damaged or missing from the property. Furniture must be returned to its original position.
3.3. Torquay Retreats has the authority to deduct monies from the Security Deposit or credit card to remedy any damage, excess cleaning, missing items, excess utilities caused by the Visitor, or to invoice the Visitor by email, phone or post for immediate payment.

4. Liability & Rental Guarantee

4.1. You agree to indemnify Torquay Retreats and the property owner from any claim of loss of personal effects or financial damage direct or indirect whatsoever incurred by you in booking any Torquay Retreats property.

5. General Conduct

5.1. The Visitor must not smoke within the property else a de-odorising fee will apply.
5.2. The Visitor must, every time they depart the property, securely lock doors and windows, and switch off lighting, appliances and water to conserve resources and avoid damage.
5.3. The Visitor shall immediately report to Torquay Retreats any repairs required or damage.
5.4. Pets are permitted and an $80 pet fee applies. The Visitor must notify Torquay Retreats of any pets at the time of booking. Failure to do so may result in termination of the booking.

6. Right to inspect the Property and re-enter the Property

6.1. Torquay Retreats has the right to inspect the property during the booking period subject to reasonable prior notice being given unless the Property Manager has reasonable grounds to believe that the property is being damaged or at risk or if the Visitor breaches any term of this agreement.

7. Arrival, Departure & Keys & Lock Outs

7.1. Visitors may check in after 2pm on the Arrival Date. Visitors must reconfirm their check-in time via email no later than 48 hours prior to arrival.
7.2. The property must be vacated by the Visitor by 10:00 am on the Departure Date, leaving keys on the kitchen bench. Failure to depart will authorise Torquay Retreats to levy additional charges for rental and costs incurred.
7.3. Visitors are responsible for keys (including access devices) and loss of keys and key/lock replacement costs will be passed on to the Visitor.

8. Cancellation by the Property Manager

8.1. In the unlikely instance that a property is withdrawn, Torquay Retreats will endeavour to locate an alternative property of similar location and features, or offer a full refund. If the Visitor selects one of the alternative properties, a new booking will be created funds will be transferred to the new booking.

9. Right of refusal and application of other Special Conditions

9.1. Torquay Retreats may refuse at its discretion to accept any Visitor. Furthermore, Torquay Retreats may require that other Special Conditions be agreed to on arrival of the Visitor.

10. Privacy and General Law

10.1. Torquay Retreats will not share your personal information with any third party, unless it is required to complete your booking, provide services to you, or settle your account.

11. CANCELLATION & REFUND POLICY (also applies for Covid positive cases)

11.1. Bookings cancelled with at least 28 days notice will receive a full refund, less the $50 booking fee.
11.2. Bookings cancelled with 7 - 28 days notice will receive a 50% refund of the total booking cost.
11.3. Bookings cancelled with less than 7 days notice will not be refunded and will be required to pay any balance outstanding on the total booking cost.
11.4 All cancellation requests must be made in writing to admin@torquayretreats.com.au

Christmas and New Year Periods (23rd December - 31st January):

11.5 Bookings cancelled 90 days or less before the arrival date will forfeit 100% of the total rental amount. In the event of a cancellation, if the property is able to be resold the client may receive a partial refund, at the discretion of the owner.

Payment Policy

How to pay the Deposit

To reserve your accommodation, an automated 50% deposit will be charged to your credit card at the time of booking. A 2% service fee applies to all credit card payments.

We accept MasterCard and Visa credit Cards.

The balance will be due one week prior to arrival and can be paid via credit card, bank transfer or cash on arrival.
If payment has not been received upon check out, we have the right to charge the credit card on file for the balance.
